The reductionist view of contractual phenomenon, typical of civil codes and classical contract law, is a result of a blur that, overestimating the voluntary agreement, undervalues the exchange. Trying to show the partial and inadequate character of that vision of contract law, contextualists or relationists proposals have emerged, focusing on the defense of the relational contract model. These theories suggest relational justice as a new paradigm. It transfers the relational approach of sociology to law, and incorporates the analysis of plural (...) economic reciprocity. Relational justice is formulated as a theory of justice, whose three elements offer a new theoretical framework where balances and imbalances that have been showing the legal contractual reality through out history can be contextualized. Critical theory must add to its agenda “disrupt[ing] the easy passage from critique [to] its neoliberal double”, Nancy Fraser recently argued. Emancipatory movements have not only been transformed by neoliberalism. They have, “unwittingly”, provided powerful “ingredients” for the transition to neoliberalism. This essay examines Axel Honneth and Nancy Fraser’s assessment of and normative proposal for addressing the paradoxes of neoliberalism. The constraints of neoliberalism, I argue, bring into focus the structural challenge of immanent critique as understood within second and third (...) generation Critical Theory. Normative ambivalence within neoliberalism, I maintain, calls for a shift in the way that critical and justificatory practices are understood within the Frankfurt School. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Adrian Del Caro PAUL CELAN'S UNCANNY SPEECH On October 22, 1960, Paul Celan was in Darmstadt, West Germany, to accept the prestigious Georg-Bûchner-Preis. Winners of this prize are required by custom to give a speech on some aspect of Georg Büchner's writings, and Celan followed suit with a speech entitled "Der Meridian." The speech itself, as an address given in German in Germany to German listeners, was uncanny, (...) but it was Celan's "uncanny" discourse that had earned him this prize in the first place. In his poetry die uncanny takes on a life of its own. In the Meridian speech, dimensions of the uncanny in Büchner's writings are explored for the purpose of shedding light on the artistic impulse, and on poetry in particular. The poetic of Paul Celan is difficult to define from the aggregate of his poems, and hardly transparent in the Meridian speech, either. But it is the concentration on the uncanny in "Meridian" that makes the effort worthwhile. I will use the Meridian speech, examples from German literature, and examples of Celan's poems to unpack this uncanny. "Meridian," like so many words chosen by Celan, is full. Among the things it can mean are highest point, prime of life, circle from pole to pole, and lines numbered according to degrees of longitude. We speak also of a prime meridian, namely Greenwich, having the property of a center, of a locus from which we determine our bearings. Celan the linguist and etymologist knew and considered all meanings. "Uncanny" as a translation of German das Unheimliche is not quite sufficient, but it is a good starting point. German heim is English home, and unheimlich, unheimisch would be unhomely or unhomey—at least in the etymological spirit. When things are not as they are at home, they are unheimlich. Grimm's dictionary tells us that it wasn't until die end of Philosophy and Literature, © 1994, 18: 211-224 212Philosophy and Literature the eighteenth century that an emotive quality was added to this formerly cognitive adjective; it began at diis time to be associated with feelings of terror, dread, and anxiety. The Romantic Ludwig Tieck was among the first German writers to treat supernatural, uncanny themes, and as unheimlich became associated with the supernatural, it began to lose its sense of homeliness. Later on, E. T. A. Hoffmann became a master of die uncanny in his numerous weird tales. English "uncanny," which is still the best translation we have for unheimlich, experienced a similar development away from its origins in Scottish, where canny meant quiet, snug, cozy, and pleasant. The Oxford English Dictionary tells us that "supernatural, mysterious, uncomfortably strange or unfamiliar" were properties ascribed to "uncanny" after 1850. Poe's writings are uncanny in this modern sense. Freud devoted an essay to the uncanny in 1919. He made die point diat das Unheimliche is merely das Heimliche that we have repressed. Ifwe romanticize this idea, dien in the beginning all things were heimlich or homey to us, and it is only after consciousness thatwe become alienated from our home in nature, a condition which makes us feel unheimlich. Celan certainly had strong reason to focus on the earliest meaning of unheimlich, since he experienced homelessness in virtually every conceivable sense of the word, but then, so did his people, dieJews; first in their experience of the Diaspora, then in their "final" eradication during the Holocaust. The people without Boden or land became, by 1945, a people no longer of die earth. Freud linked the concept of das Unheimliche to its origin in heimlich. After exhaustively quoting the lexicologists Sanders and Grimm, Freud concluded that only Schelling had added a new dimension to das Unheimliche: "Uncanny would be everything that is supposed to remain a secret, remain concealed, but has emerged."1 This is credible enough, and fits Freud's repression theory. Freud's statement at the conclusion of the first part of his long essay would have appealed to Celan: "Heimlich is a word according to whose meaning an ambivalence develops until finally it corresponds in any uncanny way with its opposite. Hegel’s Theory of Intelligibility picks up on recent revisionist readings of Hegel to offer a productive new interpretation of his notoriously difficult work, the Science of Logic. Rocío Zambrana transforms the revisionist tradition by distilling the theory of normativity that Hegel elaborates in the Science of Logic within the context of his signature treatment of negativity, unveiling how both features of his system of thought operate on his theory of intelligibility. Zambrana clarifies crucial features of Hegel’s theory of normativity (...) previously thought to be absent from the argument of the Science of Logic—what she calls normative precariousness and normative ambivalence. She shows that Hegel’s theory of determinacy views intelligibility as both precarious, the result of practices and institutions that gain and lose authority throughout history, and ambivalent, accommodating opposite meanings and valences even when enjoying normative authority. In this way, Zambrana shows that the Science of Logic provides the philosophical justification for the necessary historicity of intelligibility. Intervening in several recent developments in the study of Kant, Hegel, and German Idealism more broadly, this book provides a productive new understanding of the value of Hegel’s systematic ambitions. Practical wisdom eliminativism has recently been proposed in both philosophy and psychology, on the grounds of the alleged redundancy of practical wisdom (Miller 2021 ) and its purported developmental/psychological implausibility (Lapsley 2021 ). Here we respond to these challenges by drawing on an improved version of a view of practical wisdom, the “Aretai model”, that we have presented elsewhere (De Caro et al. 2021 ; Vaccarezza et al. 2023 ; De Caro et al. forthcoming ). According to this (...) model, practical wisdom is conceptualized: (i) as virtuousness _tout court_, i.e., as the _ratio essendi_ of the virtues, and (ii) as a form of ethical expertise. By appealing to the first thesis, we counter the charge of psychological implausibility, while we rely on the second thesis to address the accusation of redundancy. In conclusion we argue that the Aretai model implies a significant paradigm shift in virtue ethics. Practical wisdom emerges as both necessary and sufficient for virtuousness, thereby downsizing – without eliminating entirely – the role that individual virtues play in our ethical lives. (shrink)

The current study analyzed how trait emotional intelligence (trait EI) mediates the relationship between self-esteem and state anxiety (STAI-S) and trait anxiety (STAI-T). The sample was composed of 153 undergraduate students from the University of Cádiz, Spain (71.9% women and 28.1% men). Students completed measures of self-esteem, STAI-S, STAI-T, and trait EI. Mediation analyses were completed with three trait EI dimensions (emotional attention -EA-, emotional clarity -EC-, and mood repair -MR) as mediating variables, self-esteem as the independent variable, and STAI-S (...) and STAI-T as the dependent ones. Our results confirmed that self-esteem scores explained and predicted both, STAI-S and STAI-T values (13% for STAI-S and 21% for STAI-T). This explanatory capacity is increased by 8% when accounting for all trait EI dimensions. Considering STAI-S, the results of the direct effects showed that a decrease in their levels is predicted through the increases in the levels of both, self-esteem and MR. Regarding STAI-T, the results of the direct effects showed that a decrease in their levels is predicted, in addition to an increment of self-esteem and MR values, by an increase of EC and a decrease of EA. Conversely, indirect effects revealed that higher levels of self-esteem were associated with worse scores in EA and worse MR, which in turn would enhance both STAI-S and STAI-T levels. Moreover, regarding STAI-T higher levels of self-esteem were associated with worse scores in EA and worse EC, therefore increasing STAI-T levels. As shown, the negative association found between self-esteem and EA becomes a key element. The effect of self-esteem on EA and the influence that the latter had on EC and MR exerts an indirect mediated effect with the power to invert the influence that self-esteem wields on both types of anxiety. In this sense, the apparent protective role of self-esteem changed, turning into a risk factor that promotes higher anxiety values. (shrink)

Grounding refers to expressions that establish a connection between the ground and the content evoked by a nominal or finite clause. In this paper we report on two grammatical implementations of nominal grounding in Argentine Sign Language: pointing and placing. For pointing constructions, we also examine distal-proximal pointing and directive force. We introduce the concept of placing, in which a sign is produced at a specific meaningful location in space. Two types of placing are discussed: Placing-for-Creating, in which a new (...) meaningful location is created, and Placing-by-Recruiting, which recruits an existing meaningful location. We suggest that our analysis of pointing and placing provides an account of nominal grounding unified by general cognitive principles as described within the theory of Cognitive Grammar. Pointing is known to occur in all signed languages studied to date. Although previously undocumented, we suggest that placing is also common to many, perhaps all, signed languages. (shrink)

Normativity concerns what we ought to think or do and the evaluations we make. For example, we say that we ought to think consistently, we ought to keep our promises, or that Mozart is a better composer than Salieri. Yet what philosophical moral can we draw from the apparent absence of normativity in the scientific image of the world? For scientific naturalists, the moral is that the normative must be reduced to the nonnormative, while for nonnaturalists, the moral is that (...) there must be a transcendent realm of norms. _Naturalism and Normativity_ engages with both sides of this debate. Essays explore philosophical options for understanding normativity in the space between scientific naturalism and Platonic supernaturalism. They articulate a liberal conception of philosophy that is neither reducible to the sciences nor completely independent of them—yet one that maintains the right to call itself naturalism. Contributors think in new ways about the relations among the scientific worldview, our experience of norms and values, and our movements in the space of reason. Detailed discussions include the relationship between philosophy and science, physicalism and ontological pluralism, the realm of the ordinary, objectivity and subjectivity, truth and justification, and the liberal naturalisms of Donald Davidson, John Dewey, John McDowell, and Ludwig Wittgenstein. The research analyzes the teledentistry service applied in health services during COVID-19, studying the quality of the teledentistry service and the level of satisfaction of patients treated with this care model. A sample of 341 patients was worked on, using the SERVQUAL model. The results showed a statistically significant relationship between quality of service in teledentistry and patient satisfaction (p<0.05), where 34.9% patients perceived low quality of service and dissatisfaction, while 33.7% were pleased with the care. We conclude that, given (...) the dental health difficulties, the population of the Peruvian central jungle is dissatisfied with the teledentistry service. (shrink)

In “Violence and Metaphysics” Jacques Derrida suggests that “the only effective position to take in order not to be enveloped by Hegel would seem to be…to consider false-infinity…irreducible.” Inversely, refuting the charge of logocentrism associated with Hegelian true infinity ( wahrhafte Unendlichkeit ) would involve showing that Hegel’s speculative logic does not establish the infinity of being exempt from the negativity of the finite. This paper takes up Derrida’s challenge, and argues that true infinity is crucial to Hegel’s understanding of (...) ideality as a question of normative authority, which does not fall prey to logocentrism. Through an exposition of the dialectic of the finite and the infinite in Hegel’s Science of Logic , I argue that true infinity is not an ontological category that eliminates division, but rather refers to the metalogical standpoint involved in a philosophical account of determinacy. Although fully achieved at the end of the Logic , the metalogical standpoint that Hegel elaborates in the Seinslogik under the banner of the true infinite already clarifies that determinacy is a product of normative authority that is itself precarious. Some mutual funds not only apply the usual asset management and custodial fees, but also front loads and redemption fees as a kind of ‘toll charge’ payable on entering and/or leaving the fund. The aim of this work is to examine the implications of the different loads and fees applied to mutual fund investors in the Spanish market. The results show that there is a relationship between the various charges and fees. The fact that load fund companies charge higher management (...) and custody fees proves the potential of the fund companies to impose higher fees on a segment of the clientele. The investors in load funds, which tend to be large in number of shareholders and belonging to banks and savings banks, are small investors who show a low cost sensitivity. A lower level of financial sophistication may be the reason for the apparent lower price awareness. The problem is that the investors in load funds are not financially compensated for the extra cost represented by the front‐load and redemption fees. The only beneficiary seems to be the financial institution itself. On this view, the survival of load funds seems to depend on the lack of financial sophistication of their clientele, combined with market inefficiencies. It is worth asking about the ethics of a situation of market segmentation that allows managing institutions to benefit from the segment of the least sophisticated investors. (shrink)

Este trabajo se centra en el papel que juega la afectividad en la conocida como transformación hermenéutica de la fenomenología llevada a cabo por el joven Martin Heidegger. Tras establecer en la introducción la estrecha vinculación que existe entre la afectividad y la facticidad, tomo como hilo conductor la noción de movilidad de la vida fáctica. En un primer momento explico la peculiar significación que adquiere este término en la filosofía del joven Heidegger. En segundo lugar me detengo a analizar (...) la doble “movilidad fundamental” del amor y el odio como la matriz intencional del curare en la interpretación heideggeriana de las Confesiones de San Agustín durante las lecciones del semestre de verano de 1921. En un tercer momento considero la doble movilidad del pathos y de la disposición afectiva en las lecciones de 1924,_ Conceptos fundamentales de la filosofía aristotélica_. Y, _finalmente_, explicito la “lógica del corazón” que subyace a la hermenéutica de la facticidad desde la confluencia de la tradición neotestamentaria del _affectus _ y la tradición griega del _pathos_. El presente artículo se inscribe dentro de un proyecto que busca examinar la construcción discursiva de la organización política argentina denominada Juventud Peronista. En el presente trabajo, se analizan tres noticias aparecidas en el diario “La Nación”, correspondientes a un acto encabezado por Cristina Fernández y organizado por distintas corrientes militantes kirchneristas, en conmemoración de la victoria electoral de Héctor Cámpora, el 11 de marzo de 2011. Este acto supuso el afianzamiento de la Juventud Peronista actual en la escena política (...) argentina. El objetivo del trabajo es examinar la forma en que se presenta a los jóvenes militantes kirchneristas a partir de un análisis de la transactividad para observar el rol que se les adjudica como actores sociales. Para la consecución del análisis, se utilizan principalmente las herramientas de la Lingüística Crítica, las cuales se complementarán con la Teoría de la Valoración. El Análisis Crítico del Discurso constituye el marco teórico en el cual se inscribe el proyecto. Concluiremos que si bien los militantes, en general, y los jóvenes, en particular, aparecen mayormente en el rol de agente y no de afectado, se trata de acciones secundarias, en tanto organizadores del acto; acciones que semánticamente connotan pasividad, por ejemplo, pedidos que la Presidenta debe cumplir; o acciones incluidas en el discurso referido de Cristina Fernández. Los trastornos básicos son la ansiedad y la depresión, con sus modalidades y variedades. The aim of this research is to analyse the socio-pedagogical actions carried out in Spanish prisons. To do so, we begin by analysing the main regulations covering educational policy in prisons, share as an essential axis the orientation of the custodial sentence towards the re-education and social reintegration of the prisoners, serving as a basis for justifying social intervention. Secondly, we analysed the prison population, where we observed a prevalence of men over women, a greater presence of crimes related to (...) material offences and an average age of the population between 35 and 45 years old. Thirdly, based on the legislative and contextualized review, we analysed the programmes that are carried out in prison, the socio-educational potentials that may arise, through their principal objectives and the target groups they are aimed at, with the purpose of detecting good socio-educational practices. We underline the social and pedagogical function of these activities, as opposed to the therapeutic vision from which they emanate, highlighting the emancipatory potential of such an approach. Finally, we conclude with the professionalizing principles that can guide good practices in socio-educational intervention in prison, both in the Spanish context and in other countries with similar characteristics. Answering the challenge of G. W. F. Hegel's idealism and its perceived logocentrism has arguably been a defining feature of nineteenth- and twentieth-century continental philosophy. Today, in the midst of a Hegel renaissance, Hegel's legacy within continental philosophy is far more ambivalent. In this essay, I cut across debates about the status of Hegel's idealism in order to offer a reflection on the legacy of Hegel by reconstructing a Hegelian notion of legacy. I develop this notion in response to Jacques (...) Derrida's discussion of inheritance in Specters of Marx (1993). Both Hegel and Derrida articulate the structure of legacy, inheritance, and history on the basis of the strictures of gathering. For both, gathering is an act of memory that determines a legacy as a legacy, a history as a history. Gathering determines an event, norm, idea, or institution as something to be passed on for a future to come. While Derrida concludes that inheritance implies decision, Hegel's recollection provides the basis for what I will call a critical history, which contributes to any such decision in crucial ways. In response to recent work on the nature of human aggression, and to shed light on the proximate, as opposed to ultimate, causes of tribal warfare, we present a record of events leading to a fatal Waorani raid on a family from another tribe, followed by a detailed first-person observation of the behavior of the raiders as they prepared themselves for war, and upon their return. We contrast this attack with other Waorani aggressions and speculate on evidence regarding their hormonal (...) underpinnings. On-the-ground ethnographic observations are examined in light of the neuroendocrinological literature. The evidence suggests a chain of causality in launching lethal violence, beginning with a perceived injury, culminating in a massacre, and terminating in rejoicing. Although no blood or saliva samples were taken at the time of this raid, the behaviors were consistent with a deliberate initiation of the hormonal cascade characterizing the “fight-or-flight” response, along with other hormonal changes. We conclude with observations on the stratified interrelationships of the cognitive, social, emotional, and neuroendocrinological causes of aggression leading to coalitional male homicide. (shrink)

This paper has a twofold aim. On the one hand, we will discuss the much debated question of the source of normativity (which traditionally has nature and practical reason as the two main contenders to this role) and propose a new answer to it. Second, in answering this question, we will present a new account of practical wisdom, which conceives of the ethical virtues as ultimately unified in the chief virtue of phronesis, understood as ethical expertise. To do so, we (...) will first criticize the main current view of phronesis and its bearer (the phronimos), then offer another view of the nature of phronesis and of its relation to the other ethical virtues. Our proposal should not be intended as an interpretation of Aristotle’s own view; rather, it should be seen as a broadly Aristotelian theoretical proposal, which we believe can satisfyingly address most of the problems that afflict the more traditional accounts of practical wisdom. In section 2 of this paper, after criticizing first-nature naturalistic views of moral virtue, we take practical reason to be the cornerstone of second-nature naturalistic views; in section 3, we will outline criticisms to which, in our view, the traditional views of phronesis are ill-suited to respond, and, in section 4, we will outline our view of phronesis as ethical expertise – a view which in our view is immune to the above-mentioned criticisms – by spelling out the three main tenets of phronesis as ethical expertise: a conceptual thesis, an epistemic thesis, and the educational implications of the two. Finally, we will support our proposal with some empirical evidence taken from cognitive science. (shrink)

Nowadays, students are experiencing difficult and stressful situations due to the Global Pandemic Alert. This changing world can evoke negative emotions that have been traditionally linked to higher anxiety. Researches have been focused on the positive outcomes of trait emotional intelligence preventing psychological disorders. However, the possibility that TEI might have a dark side has been neglected. Hence, this study aimed to explore the mediating effect of the three dimensions of TEI in the relationship between negative affect and anxiety symptoms (...) among college students. Participants of this research were 467 undergraduates who completed an online self-reported questionnaire including the Positive and Negative Affect Schedule, the State-Trait Anxiety Inventory, and Trait Meta-Mood Scale. The global serial mediation model showed that the total amount of variance explained by the global model was 30.8%. Negative affectivity and age accounted for the 15.1% of state anxiety variance while 15.7% of the variance of state anxiety was attributed to the direct or indirect effect of the three dimensions of TEI. Five indirect effects presented statistical significance. The contrast analyses between mediators showed that three indirect effects had higher statistical weigh; the ability of negative affect to increase state anxiety through emotional attention; emotional clarity, and serially through emotional clarity and mood repair. Our results indicated that students’ negative emotions lead to higher emotional attention which in turn may enhance state anxiety in two ways: by a direct effect of emotional attention on state anxiety and by a serial effect through emotional clarity. Moreover, when negative affect is associated with lower emotional clarity, anxiety symptoms may also arise. However, when attention and clarity are connected, the negative effect is reversed into a positive one, decreasing state anxiety. (shrink)

Levinas is often credited with introducing a strong notion of ethics into postmodern thought. But his commitment to Zionism, his views on the Palestinian people, and his underformulated theory of justice raise questions about the desirability of his thinking for politics. In this study, the well-known encounter between Levinas and the Palestinians is addressed in order to determine how his philosophy of ethics can be deployed for political ends. As the philosopher famously concerned with the connection between self and the (...) Other, the relation between Levinas, Israel and the Palestinians stands as the natural political test of his ethics. Based on this encounter, it is demonstrated that Levinasian justice is too unsafe as a prescription for a political order. Only when Levinas' ethics as first philosophy is supported by love as first politics is his Messianic polity acceptable. (shrink)

El desarrollo de esta tesis se localiza dentro del campo de los estudios de la memoria y la historia a partir de la reconstrucción del contexto socio-histórico en el cual se desenvuelve el grupo guerrillero colombiano Movimiento 19 de abril (M-19), desde su surgimiento hasta su disolución (1974-1990), a la luz de la articulación entre las diversas estrategias de propaganda que desplegó en los medios de comunicación y el examen de un conjunto de tópicos que evidencian el carácter populista de (...) su proyecto político. En efecto, es en el análisis de su estrategia populista donde esta tesis presenta una línea de análisis novedosa, pues no se reduce el fenómeno a la lucha armada, sino que se privilegia el estudio de sus estrategias de comunicación política, desentrañando los modos en que la organización buscaba generar consenso entre la población. In this article, the dominant legitimating discursive strategies around the ever-increasing labour demands and ever-declining standards of safety and well-being at work in Spain are analysed through the lens of Boltanski and Thévenot’s (2006) view of the transformation of capitalism. A qualitative methodology based on semi-structured interviews is used. Results show that the justificatory arguments most commonly put forward by managers and experts are the logic of supply and demand, and values related to flexibility, resilience and adaptability to change. In (...) contrast, the stability and protection established in the twentieth century are widely cherished values, particularly among union representatives and some human resources specialists. We found that discourse practices map two specific legitimating categories (market values and a projects orientation), and one critical category (Civic World), but the critical category has no practical impact, as the predominant feeling is resignation. Our research describes the common attitudes to legitimacy in the job market and points to a deep discontent in some of its key agents. (shrink)

Recent discussions of Hegel’s conception of second nature, specifically focused on Hegel’s notion of habit, have greatly advanced our understanding of Hegel’s views on embodied normativity. This essay examines Hegel’s account of embodied normativity in relation to his assessment of good and bad habits. Engaging Hegel’s account of the rabble in the Philosophy of Right and Frank Ruda’s assessment of Hegel’s rabble, this essay traces the relation between ethicality, idleness and race in Hegel. In embodying a position of refusal in (...) its affirmation of idleness, the rabble disallows the progressive revision of the project of modernity central to Hegel’s philosophy. Hegel’s discussion of the rabble is thus key to assessing the production of race within Hegel’s notion of ethical life. (shrink)

The superhuman (Übermensch) is a human being attuned to his or her environment in such a way that human and environment function as a whole, in keeping with Zarathustra’s prophecy that the superhuman is the meaning of the Earth. Nietzsche’s rhetorical embrace of the Earth in Thus Spoke Zarathustra is actually grounded in the works of the 1870s, in particular Human, All Too Human, whichdoes not receive its due in critical engagement but which requires serious critical revisitation if the ecological (...) Nietzsche is to be heard above his own rhetoric. When Nietzsche’s writings are considered from the standpoint of ecology, it emerges that the phrase “the superhuman shall be the meaning of the Earth” is not so much focused on a debatable vision of future humanity, but instead addresses strategies for inhabiting our finite Earth in a spirit of creativity, partnership, and meaningful daily interaction. The hotly debated doctrine of will to power, for example, undergoes clarification and grounding when subjected to ecological standards, resulting in a will to empowerment whose beneficiaries are not only humans who assume proper stewardship of the Earth, but all Earthly life forms insofar as the meaning of Earth must include them. La pregunta por el ser humano ha sido una constante en la Historia del pensamiento, sin que se pongan de acuerdo las personas especialistas en la materia en qué sea aquello que cualifica a la realidad humana. El artículo presente contribuye al debate abierto en la antropología filosófica desde el pensamiento de Xavier Zubiri. Atendiendo fundamentalmente a la obra de este autor, se presenta lo que, en su opinión, constituye lo específico del ser humano, que es ser una realidad abierta (...) y proyectiva.
